1. Acceptance of Terms & Services
By creating a merchant account, accessing the dashboard, or utilizing the Pistio AI automated support widget and integrations, you agree to comply with and be bound by these Terms of Service. If you are entering into this agreement on behalf of a company or other legal business entity, you represent that you hold the legal authority to bind such entity.
2. Meta WhatsApp Business API Integration
Pistio AI integrates directly with the Meta WhatsApp Business API using merchant-provided credentials or system-approved developer channels. Merchants must strictly adhere to the following rules:
- Compliance with the official Meta WhatsApp Business Policy and commercial guidelines.
- Zero-tolerance policy for spamming, sending unsolicited templates, or broadcasting forbidden products.
- Merchants accept that WhatsApp template costs and active conversation fees are billed directly to the merchant by Meta. Pistio AI is strictly a software middleware layer and holds no liability over Meta billing rates.
3. Subscription Billing & Non-Cancellable Terms
All recurring monthly or annual platform subscription fees are billed in advance.
Subscription terms are **strictly active and non-cancellable** for the duration of the current paid billing cycle. No cancellations, early terminations, or refunds are permitted once billing has occurred. Failure of subscription payment triggers a five (5) calendar day grace period, after which integrations (including AI automation endpoints) are suspended.
4. Intellectual Property & AI Models
Pistio AI retains all legal rights, title, and interest in and to the platform codebase, support console designs, custom visual tracking systems, proprietary routing models, and any algorithms developed. Merchants are granted a non-exclusive, non-transferable, revocable license to access the platform services during their active subscription term.
5. Dispute Resolution & Bhopal Jurisdiction
These Terms of Service and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of India.
Any legal action, suit, or proceeding arising under this agreement must be brought exclusively in the competent civil courts located in Bhopal, Madhya Pradesh, India, and both parties hereby consent to the exclusive jurisdiction of such courts.
